What are the short-term rental rules and taxes on the Outer Banks in Dare County, NC?

Answer7 min readBy HostCalmlyUpdated Nov 4, 2026How we check factsReport an error

Short answer

Dare County charges a 6% occupancy tax on rentals and its combined state and local sales tax is 6.75%, so the official rates add to 12.75%. Airbnb and Vrbo say they collect North Carolina sales tax and local occupancy tax on stays under 90 nights. Town rules differ. Nags Head, for example, requires an annual short-term rental registration by Sept 1, so check your town's planning office before you host.

On the Outer Banks, the tax side is countywide and fairly simple, while the rules side changes from town to town. Dare County runs one occupancy tax for the whole county and splits part of it with the six towns. Zoning, registration and parking are set by each town, or by the county for unincorporated communities such as Avon, Buxton, Frisco and Hatteras. Everything below comes from county, town, state and platform pages, linked where it's used.

Do you need a permit or registration

Dare County

The county's business license page (opens in a new tab) says businesses outside the towns may not need a business license but are subject to business personal property tax, and that weekly rental businesses are subject to occupancy tax. It does not set out a short-term rental permit. For zoning in unincorporated areas, the county's zoning page (opens in a new tab) sends property questions to the Dare County Planning Office at 252.475.5870 and says some recent ordinance updates may not yet appear in the online code.

The towns

The county page says businesses in Nags Head, Manteo and Kill Devil Hills may need a town privilege license. Each town sets its own rules, so start with the town where the home sits.

For the towns marked "not found", call the town's planning or permits office and ask the questions in how to find the rules for your city.

Nags Head registration

The Nags Head short-term rental registration page (opens in a new tab) says owners or operators must register before renting or offering a property, unless exempt. It covers whole-house rentals (a whole single-family home rented for under 30 days) and partial-house rentals (a resident-occupied home renting up to two guest rooms for under 30 days) in every zoning district.

  • Exempt: rentals managed by a real estate broker under G.S. 93A-2(a), hotels and similar lodging, rentals to people with no other primary residence, and rentals for nominal consideration.
  • When: every year, renewed on or before Sept 1.
  • How: the town's online registration form.
  • Fee: the town's 2020 registration form (opens in a new tab) lists $25 per property. The current page doesn't state a fee, so confirm it.
  • What you provide: address, PIN and parcel number, bedrooms, parking spaces, owner and operator contacts, an optional local contact, and whether you carry liability coverage for the rental use.
  • Acknowledgment: you confirm you know about the NC Vacation Rental Act and your duty to pay sales and occupancy taxes.
  • Partial-house limit: more than two rented bedrooms may make it a bed and breakfast, which needs a conditional use permit.

The county's three occupancy taxes total 6%. Combined, using only these official rates: 6.75% sales tax + 6% occupancy tax = 12.75%. The NCDOR rate table read is the version effective July 1, 2026. The county page says two-thirds of the 3% tax goes to the six towns. None of the pages read shows a separate town occupancy tax. Confirm with the Dare County tax department.

Exemptions on the county page: a private residence or cottage rented for fewer than 15 days in a calendar year, and stays of 90 or more continuous days with the same person.

What's taxed: NCDOR's rentals of accommodations page (opens in a new tab) lists cleaning, pet, damage, reservation and credit card fees as part of taxable gross receipts.

What Airbnb and Vrbo collect for you there

Airbnb. Airbnb's North Carolina tax article (opens in a new tab) says it collects and remits state and local sales tax (6.75% to 7.5% depending on county) and all locally imposed occupancy taxes on reservations under 90 nights, on the listing price including cleaning and guest fees.

Vrbo. Vrbo's N to Z tax list (opens in a new tab) shows it collects North Carolina state and local sales and use tax plus city and county occupancy tax on stays under 90 nights, starting Oct 1, 2019.

What stays your job:

  • Both taxes on direct bookings and on any channel that doesn't remit. Vrbo's general tax page (opens in a new tab) names bookings made outside its online system and through connected software as cases to check with local authorities.
  • Town registration or licensing, and county business personal property tax.
  • Keeping each platform's monthly tax reports as proof of what was remitted.

The Dare County page does not say whether a host must file a county return for months when every booking came through a platform that remitted. Ask the Occupancy Tax Department at 252.475.5964.

Filing and registering for the taxes you must file yourself

Dare County occupancy tax (county page (opens in a new tab)):

  1. File monthly, on the county's form, reporting the prior month's gross receipts.
  2. File and pay on or before the 20th of the month after the tax accrues.
  3. Mail the return and a check payable to the county to P.O. Box 1000, Manteo, NC 27954. The page mentions an eCheck option but gives no details.
  4. Penalties: a late return costs 5% of the tax for the first month and 5% more for each extra month, up to 25% ($5 minimum). Late payment costs 2% a month, up to 10%.

NC sales tax. NCDOR's accommodations page says returns go on Form E-500, filed and paid online. Filing frequency isn't stated there, so confirm it when you register. NCDOR's general line is 1-877-252-3052.

This is not tax advice. A CPA who works with Outer Banks rentals can confirm your filings.

Other local rules

  • Smoke and CO alarms. Nags Head says your rental is likely subject to the NC Vacation Rental Act. G.S. 42A-31 (opens in a new tab) requires working smoke alarms with new batteries every year. CO alarms are required where there is a fossil-fuel heater, appliance or fireplace, or an attached garage, at least one per level, checked at least every six months, and repaired within three days of written notice. Our alarm count guide works out how many you need.
  • Fit and habitable. The same section requires you to keep the property fit and habitable and to promptly repair supplied systems and major appliances after written notice.
  • Fire extinguisher. The statute text read does not state one. Ask your town's fire marshal.
  • Parking (Nags Head). Whole-house rentals need no parking beyond the single-family minimum, which is bedrooms minus 2, with at least 2 spaces. Partial-house rentals need one extra space.
  • Insurance. Nags Head doesn't require liability coverage, but it warns that a standard homeowners policy likely excludes rental use. See short-term rental insurance basics.
  • Occupancy limits and noise. Not stated on the town and county pages read. Confirm with your town.

The vacation rental safety checklist covers the rest of the safety kit.
